Auto Accident Injury PIP Laws

PIP, or personal injury protection, has specific requirements for victims of auto accidents.

There’s a Time Limit

In order for auto insurance to cover your healthcare, you must seek treatment within 14 days of being involved in a car accident. If you do not obtain care in that timeframe, you void your ability to obtain PIP coverage for the treatment you may need.

Often, you may not feel injuries sustained to your body immediately after an accident – so if you have any muscle soreness in your neck, in your mid-back, in your low-back or anywhere in your body seek a physician’s advice within the first 2 weeks. If you wait until after the 2 week period to visit your physician and chiropractor, you will not be able to use the medical benefits covered under your policy.

Total Coverage Amounts

To obtain the full amount of coverage, individuals must have an “emergency medical condition.” You will need to obtain an emergency medical certificate from a physician so that your PIP Coverage encompasses the full $10,000 policy otherwise the policy only has a $2,500 limit. In some situations, chiropractic care can be obtained over the $2,500 value. However, the law does not require insurance companies to provide victims with coverage for acupuncture treatment or massage therapy.

If you cannot receive coverage over the $2,500 threshold and still need care, you can continue to receive treatment under a Letter of Protection, which is obtained through an attorney who is filing a claim for you. You have the right to seek out legal counsel for the early termination of your PIP benefits.

Impact on Your Premiums

There is no rule in Florida’s PIP law that requires insurance companies to reduce costs for newly reduced benefits, though carriers are encouraged to provide a 10% reduction in premiums.
